This page gives you information about us and the legal terms and conditions on which we sell any of the products listed on our website to you.

These legal terms and conditions will apply to any contract between us for the sale of our products to you. Please read these terms and conditions carefully and make sure that you understand them, before ordering any products from our site. When ordering any of our products, you agree to be bound by these terms and conditions. You’ll be asked to confirm your acceptance of these terms and conditions before being able to place an order, without your acceptance you won’t be able to order any products from our website. You should print a copy of these terms, or save them to your computer, for future reference.

In addition to these terms and conditions, our privacy policy also applies to your use of the website and is, where relevant, incorporated by reference into these terms and conditions. We only use your personal information in accordance with the privacy policy. Please take the time to read through this as it includes important information which applies to you. Please also refer to our 'FAQs' and Support pages.

Terms of Service and Website Use

1. The contract between us

1.1 We must receive payment of the whole of the price for the goods that you order before your order can be accepted. Once payment has been received by us we will confirm that your order has been accepted by sending an email to you at the email address you provide in your order form. Our acceptance of your order brings into existence a legally binding contract between us.

2. Orders and cancellations

2.1 All orders and subscription requests received are subject to acceptance by &SISTERS Ltd (“Mooncup”), and any of its personnel, reserve the right, at our absolute discretion, to reject any order without giving reasons for our decision. In the event of rejection, we will refund or cancel any payments received in full via the payment method used to place the order. In the event of a refund, we will process this within 30 days of your order. We will not be obliged to offer any additional compensation for the disappointment suffered.

2.2 As a part of the checkout process, you will be able to select whether the products selected should be part of a subscription plan or a one-off order. You will also be able to select the frequency of recurrence (in the case of a subscription plan). By opting to create a subscription, you are agreeing to pay recurring periodic subscriptions for an indefinite time until deactivated by you or us, on the subscription terms set out in the application form you have completed on our website.

2.3 If you wish to change your subscription, please do so via the “My Account” area of the Mooncup website or by contacting us at customercare@wearemooncup.com. We’ll always do our best to make last-minute changes for you, assuming the order hasn’t already left us.

2.4 One-off orders cannot be cancelled after the order has been placed and the time of dispatch. 

2.5 You can pause or cancel a subscription at any time. In such circumstances, the pause or cancellation will take effect without charge. If your card has already been billed and the products not already dispatched, we will issue a full refund. Where notice is provided after your package has been shipped, please note you will still receive and be charged for this delivery and your pause or cancellation instruction will take effect after this delivery.

2.6 The images of the products on our site are for illustrative purposes only. The products you order and receive may vary slightly from those images, and the packaging of the Products may vary from those shown on images on our site.

3. Payments

3.1 We accept payment via debit/credit card as well as Paypal. In order to offer the best security, all our payments are processed securely by Stripe or, if selected as a payment option, Paypal.

3.2 For all ongoing subscriptions, your credit or debit card will be billed at checkout for your first delivery only. For ongoing deliveries, you will be billed on a recurring basis, depending on how often you have requested your delivery. The amount your card will be billed in any given billing cycle will be the value of your order(s) for that respective period.

3.3 If you create an account and enter your payment details, your card will be stored securely by Stripe so that you can check out on future visits without re-entering your card details. We never store or have access to your credit or debit card details.

3.4 We reserve the right to refuse deliveries to you and to cancel your account where payments have been withheld. You agree to compensate us in full for all reasonable costs and expenses (including legal costs) in obtaining payments that have not been made in accordance with these terms and conditions.

4. Prices

4.1 The prices payable for goods that you order are as set out on our website. 

4.2 You will be required to pay extra for delivery and it might not be possible for us to deliver to some locations. Our delivery charges are set out on our website, however further customs charges may apply and Mooncup is not responsible for these.

4.3 We reserve the right to increase our prices. Where a subscription account is held, price changes will occur in line with changes displayed on our website.

5. Delivery of goods to you

5.1 We will deliver the goods ordered by you to the address you give us for delivery at the time you make your order.

5.2 The time it may take to dispatch your products may vary, but as a typical example, if you selected Standard Delivery and order by 12pm on a business day, we will aim to dispatch the order within 2-3 business days. 

5.3 Mooncup delivers within the United Kingdom, Europe, and Internationally. We do not deliver to PO boxes or BFPO addresses.

5.4 You will become the owner of the goods you have ordered when they have been delivered to you. Once goods have been delivered to you they will be held at your own risk and we will not be liable for their loss or destruction.

5.5 Deliveries outside of the UK are subject to import duties and taxes which are levied once the package reaches the destination country. You must cover any additional duties, taxes or charges for customs clearance; unfortunately we have no control over these charges and cannot predict what they may be. If the duties are not paid and the parcel is returned to us, additional fees may apply and we will be unable to offer a refund as this would be utilised to cover the cost of return shipping fees.

6. Account details and security

6.1 If you choose, or you are provided with, a username, password or any other piece of information as part of our security procedures, you must treat such information as confidential and must not disclose it to any third party.

6.2 You may not authorise others to access our site using your username and password (if applicable) and you may not assign or otherwise transfer your account to any other person or entity. You must notify us immediately if you know of, or suspect, that anyone has obtained access to your account or if you otherwise become aware of any unauthorised use of your account or other security breach.

6.3 You warrant that all information you provide to us when registering an account is true and accurate. It is your responsibility to ensure the information in your account is updated regularly with any relevant changes.

7. Our promise, returns and refunds

7.1 We want you to be happy with your Mooncup products but due to the nature of the products and for hygiene reasons we cannot accept returns due to change of mind.

7.2 Returns will only be accepted if the goods are faulty, have wrongly been described or you receive an incorrect order. Please contact us within 14 days of delivery by email at customercare@wearemooncup.com

7.3 Occasionally, and for reasons beyond our control, products get damaged in transit. Should you believe your products have not arrived in great condition please send an email to customercare@wearemooncup.com with a photo of the damaged product(s) within 72 hours of receipt in order to be eligible for a refund. If we offer you a refund, we will refund you the full amount within 3 days. Please note that banks might take an additional 3-5 days to refund the amount to your card.

7.4 We cannot offer refunds, returns or exchanges for our products unless faulty.

8. Satisfaction Guarantee

8.1 The satisfaction guarantee applies to Mooncup menstrual cups and Mooncup period underwear bought online or in stores, excluding Amazon who handle their own return and refund processes (if you purchased your Mooncup from Amazon please contact them directly). 

8.2 In order to claim the satisfaction guarantee you will need to provide proof of purchase from an authorised seller, or provide your order details if you purchased your Mooncup menstrual cup or period underwear directly through our website.

8.3 The satisfaction guarantee cannot be claimed until 90 days after the date of purchase.

8.4 The satisfaction guarantee can only be claimed on one product per customer. 

8.5 The satisfaction guarantee applies to Mooncup menstrual cups and Mooncup period underwear and is valid for 6 months from the date of purchase.

8.6 The satisfaction guarantee excludes any shipping costs or customs charges that may have been incurred when purchasing the Mooncup menstrual cup or Mooncup period underwear.

8.7 To claim the satisfaction guarantee, please get in touch with your full name and proof of purchase, and let us know the reason for requesting the Satisfaction Guarantee. We will then get back in touch as soon as possible to get this arranged for you.

8.8 If you wish, we can accept unwanted Mooncup menstrual cups and dispose of them for you. Please get in touch with us if you'd like to arrange this with us.

8.9 The 90-day money-back guarantee applies only when Mooncup period underwear has been worn and cared for in accordance with our published washing and care instructions. We reserve the right to refuse a refund where products show signs of damage, misuse, or incorrect laundering inconsistent with our care guidelines.

8.10 We reserve the right to change the terms and conditions relating to the satisfaction guarantee or discontinue it at any time. Our decision on all matters relating to the satisfaction guarantee is final. If the satisfaction guarantee is discontinued, &SISTERS Ltd will endeavour to process all eligible requests made prior to the guarantee being discontinued.

9. Offers, Promotional codes and account credit

9.1 At our discretion, from time to time, we may offer products at discounted prices or via alternative promotional mechanisms. These offers are valid from the time that we introduce them to the end date of the offer and they cannot be used for purchases before the offer introduction date or after the offer end date.

9.2 In the event that a customer has made a purchase and the price of the purchased product subsequently falls or is discounted owing to a special offer, the price of the product at the time of purchase shall prevail. We are unable to offer special offer discounts for purchases that have already been made.

9.3 As our special offers are contingent on availability, we may change the terms of special offers and promotional codes, or withdraw them altogether, at any time, and without prior notice. 

9.4 We reserve the right, at our absolute discretion, to offer different personalised special offers and promotions and it will therefore only be possible for the customer in receipt of the special offer to redeem the discount.

9.5 Unless explicitly otherwise stated, free or discounted introductory offers are only available to new users of the Mooncup service, and are only available once to any one person.

9.6 Discounts and credits cannot be used in conjunction with any other offers. Unless otherwise stated, we only allow one promotion code to be used per order.

9.7 Credit expires 12 months from the date that it is added to an account. We reserve the right, at our absolute discretion, to expire or revoke credit, or to temporarily remove the ability to redeem credit on our site.

9.8 Except where otherwise stated, discounts and credits can be redeemed against both subscription and one-off products.

9.9 Discounts and voucher codes cannot be redeemed against courier delivery charges; percentage discount vouchers are applied only to the product cost unless otherwise stated.

9.10 If you misuse a discount code or coupon, we retain the right to cancel the discount and charge the full price to the order.

9.11 Special terms, conditions and exclusions apply to each individual offer. Please check specific offers for further details.

10. Gift Cards

10.1 All our usual terms and conditions apply to Gift Cards. 

10.2 Gift Cards ordered through our website will be delivered either by electronic means to the email address you specify or by physical means by way of a physical Gift Card being delivered to your chosen recipient on the date of your choosing.

10.3 Site offers and promotions (including credit) do not apply when purchasing Gift Cards.

10.4 Our Gift Cards must be redeemed on our Website, as full or part payment for products from our Website. Gift Cards cannot be exchanged for cash.

10.5 If there is any Gift Card balance outstanding upon redemption, such balance will remain as a credit balance in the Gift Card recipient’s Mooncup account. 

10.6 Where products purchased online with a Gift Card are returned, any monies owing will be refunded by way of the relevant amount of credit added to the Gift Card recipient’s account at Mooncup.

10.7 Mooncup is not responsible if a Gift Card is lost, stolen, destroyed or used without permission and no replacement will be provided in these circumstances. 

10.8 All Gift Cards are dated and expire 12 months from the date of issue otherwise stated. No refunds will be processed in respect of the purchase of Gift Cards.

11. Our Liability

11.1 Subject to clause 5.1, 5.2 and 5.3, whilst we agree to use all reasonable endeavours to ensure that the Mooncup service is fully operational and error-free we cannot guarantee this and, therefore, accept no responsibility for any interruption of the Mooncup service and shall be released from our obligations under these terms and conditions in the event of any cause beyond our reasonable control which renders the provision of the Mooncup service impossible or impractical.

11.2 If the goods we deliver are not what you ordered or are damaged or defective or the delivery is of an incorrect quantity, we shall have no liability to you unless you notify us in writing at our contact address of the problem within 10 working days of the delivery of the goods in question.

11.3 If you do not receive the goods ordered within 30 days of the date on which you ordered them, we shall have no liability to you unless you notify us in writing at our contact address of the problem within 40 days of the date on which you ordered the goods.

11.4 Save as precluded by law, we shall not in any circumstances be liable, whether in contract or tort, to you for any direct, indirect or consequential loss or damage arising from the sale or use of our goods including without limitation loss of profits, damage to property or loss of contracts. In all cases our entire liability, however arising, shall be limited to damages which shall not exceed the price paid for the goods in respect of which the claim has arisen.

11.5 You must observe and comply with all applicable regulations and legislation, including obtaining all necessary customs, import or other permits to purchase goods from our site. The importation or exportation of certain of our goods to you may be prohibited by certain national laws. We make no representation and accept no liability in respect of the export or import of the goods you purchase.

11.6 We do not accept any responsibility for any amendments or changes we may make to the information contained in our website, and we reserve the right to alter these terms and conditions or the information contained in this website at any time. You shall be responsible for reading and understanding these terms and conditions, and we do not accept responsibility for any loss or damage incurred by you or any third party as a result of your failure to do so.

11.7 We shall not be liable to any person for any loss or damage whatsoever which may arise from the use of any of the information contained in any of the materials on this website.

10.8 Notwithstanding the foregoing, nothing in these terms and conditions is intended to limit any rights you might have as a consumer under applicable local law or other statutory rights that may not be excluded nor in any way to exclude or limit our liability to you for any death or personal injury resulting from our negligence.

11.9 You are responsible for ensuring that all items sold to you are appropriate for your use and do not contain any substances that may cause you harm. Please make a written enquiry to us if you want to know any substances used in the products sold and/or in their manufacturing process and/or packaging.

12. Circumstances beyond our control

12.1 We will not be liable to you for any lack of or delay in performance, or the unavailability or failure, of this website or our services, or for any failure by us to comply with these terms and conditions, where such lack, unavailability or failure arises from any cause reasonably beyond our control, including without limitation strikes, lock-outs or other industrial action by third parties, changes in legislation including import tariffs/duties and border controls, civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war or threat or preparation for war, fire, explosion, storm, flood earthquake, subsidence, epidemic, or other natural disaster, or failure of telecommunications networks, or impossibility of the use of shipping, aircraft or other means of transport.

13.1 Unless otherwise expressly stated in these terms and conditions, all notices from you to us must be in writing and sent to our contact address and all notices from us to you will be displayed on our website from time to time.

14. Privacy

14.1 You acknowledge and agree to be bound by the terms of our privacy policy.

15. Copyright and trademarks

15.1 All of the rights, including copyright and database rights, contained in this website are owned by us and you must not copy any of the information contained in it. You further agree that you shall only use the website for legitimate, lawful purposes, and any other use shall only be permitted with our written consent.

15.2 We reserve all rights to our trademarks, our domain names and all related domains and subdomains.

15.3 Other trademarks, products and company or brand names mentioned on our site may be the trademarks of their respective owners or licensors and all rights in such trademarks are reserved to their respective owners or licensors.

16. Disclaimer

16.1 Our website and all contents of it relating to Mooncup are provided on an “as is” basis without any representation or endorsement made and without warranty of any kind whether express or implied in respect of this website and/or the information contained in it, including but not limited to the implied warranties of satisfactory quality, fitness for a particular purpose, non-infringement, compatibility, security and accuracy. Products (including any third party products) provided to you by means of this website shall have limited warranties which can be provided to you upon request to us.

16.2 We have placed links on this website to other websites we think you may want to visit. We do not vet these websites and do not have any control over their contents and therefore we cannot accept any liability in respect of the use of these websites.

16.3 Subject to these terms and conditions, you may link to our website, provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it. You must not establish a link in such a way as to suggest any form of association, approval or endorsement on our part where none exists.

16.4 We do not guarantee that our site will be secure or free from bugs or viruses. You are responsible for configuring your information technology, computer programmes and network to access our website. You should use your own virus protection software.

16.5 You must not misuse our website by knowingly introducing viruses, trojans, worms, logic bombs or other material which is malicious or technologically harmful. You must not attempt to gain unauthorised access to our website, the server on which our site is stored or any server, computer or database connected to our site. You must not attack our site via a denial-of-service attack or a distributed denial-of service attack. By breaching this provision, you may be committing a criminal offence. We will report any such breach to the relevant law enforcement authorities.

17. Invalidity

17.1 If any of these terms and conditions is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

17.2 If any of these terms and conditions should be determined to be illegal, invalid or otherwise unenforceable by reason of the laws of any state or country in which these terms and conditions are intended to be effective, then to the extent and within the jurisdiction which that Term or Condition is illegal, invalid or unenforceable, it shall be severed and deleted from that clause and the remaining terms and conditions shall survive, remain in full force and effect and continue to be binding and enforceable.

18. Entire agreement

18.1 Your statutory rights shall remain unaffected by these terms and conditions, and except in accordance with these terms and conditions (as above) all purchases are non-exchangeable, non-refundable and non-transferable.

18.2 These terms and conditions, together with our current website prices, delivery details, contact details and privacy policy, set out the whole of our agreement relating to the supply of the goods to you by us. Nothing said by any sales person on our behalf should be understood as a variation of these terms and conditions or as an authorised representation about the nature or quality of any goods offered for sale by us. Save for fraud or fraudulent misrepresentation, we shall have no liability for any such representation being untrue or misleading.

18.3 The content on our site is provided for general information only. It is not intended to amount to advice on which you should rely. You must obtain professional or specialist advice before taking, or refraining from, any action on the basis of the content on our site.

18.4 Although we make reasonable efforts to update the information and content provided on our site, we make no representations and give no warranties or guarantees, whether express or implied, that such information and content is accurate, complete or up-to-date.

19. Third party rights

19.1 Except for our affiliates, directors, employees or representatives, a person who is not a party to this agreement has no right to enforce any term of this agreement but this does not affect any right or remedy of a third party that exists or is available under any applicable law.

20. Governing law

20.1 The contract between us shall be governed by and interpreted in accordance with the laws of England and Wales and the English courts shall have jurisdiction to resolve any disputes between us.

21. Assignment

21.1 You agree that we may assign any of our rights and/or transfer, sub-contract or delegate any of our obligations under these terms and conditions. These terms and conditions are personal to you and you may not assign any of your rights or transfer, sub-contract or delegate any of your obligations under these terms and conditions without our written agreement.

22. No waiver

22.1 If we delay exercising or fail to exercise or enforce any right available to us under these terms and conditions, such delay or failure does not constitute a waiver of that right or any other rights under these terms and conditions.

23. Our right to vary these terms and conditions

23.1 We have the right to revise and amend these terms and conditions from time to time. You will be subject to the policies and terms and conditions in force at the time that you order products from us, unless any change to those policies or these terms and conditions is required to be made by law or governmental authority (in which case it will apply to orders previously placed by you), or if we notify you of the change to those policies or these terms and conditions before we send you the dispatch confirmation (in which case we have the right to assume that you have accepted the change to the terms and conditions, unless you notify us to the contrary within seven working days of receipt by you of the Products).

24. Mooncup referral programme

24.1 The Mooncup Referral Programme is open to existing customers only. Referred individuals must be new Mooncup customers who have not previously purchased from wearemooncup.com.

24.2 Referrers will receive a 15% discount for each successful referral. Additionally, referrers gain one entry per successful referral into a quarterly prize draw. There is no limit to the number of referrals a referrer can make.

24.3 Referred customers will receive 25% off their first purchase. This discount applies to first purchases only and cannot be combined with other offers or promotions.

24.4 Byway travel voucher prize draw terms. This prize draw is now closed, future prize draws will be specified here.

24.5 Referrers will receive a unique referral code or link to share with new customers. A referral is only considered successful once the referred customer completes a purchase using the referral code or link.

24.6 Referral discounts will be issued as unique codes via email after each successful referral and can only be used once per transaction. These discounts cannot be exchanged for cash or combined with other promotions.

24.7 Mooncup reserves the right to amend or terminate the programme at any time without notice. Any changes will be announced on wearemooncup.com.

24.8 Mooncup is not liable for technical failures or delays affecting the Referral Programme. Participation in the programme constitutes acceptance of these terms.

25. Mooncup rewards system

25.1 Mooncup rewards are available to all registered customers on wearemooncup.com. 

25.2 Points can be earned by making purchases: Points are awarded based on the product subtotal (excluding shipping, taxes, and discounts).

25.3 Points may be redeemed for discounts on purchases at wearemooncup.com. Redeemed points cannot be converted into cash or combined with other discounts or promotional offers unless otherwise specified.

25.4 Points have no monetary value and are non-transferable. Points expire 12 months from the date they are earned, unless otherwise stated.

25.5 Mooncup reserves the right to adjust points balances if fraudulent activity or errors are detected.

25.6 Mooncup retains the right to amend or discontinue the Rewards System at any time. Changes will be communicated via wearemooncup.com.

25.7 Participation in the Rewards System constitutes acceptance of these terms.

All other terms and conditions remain unaffected.

26 RECAP Partnership

26.1 This promotion is run in partnership with the Cambridgeshire and Peterborough Waste Partnership RECAP (covering Huntingdonshire, Peterborough, East Cambridgeshire, Fenland, South Cambridgeshire, and Cambridge City) and is subject to the following terms:

27.1 Membership & Eligibility

27.2 Confidentiality & Competitor Agreement

By joining, you confirm that you do not work for, consult for, or have any direct contact with a competitor in the period care industry.

27.3 Participation

Your involvement is voluntary, and you can opt out at any time.
